The Road Accident Fund (RAF) exists to provide compensation to road accident victims in South Africa. Whether you were a driver, passenger, motorcyclist, cyclist or pedestrian, as a road user, you are entitled to cover under the Road Accident Fund Act.

What can I claim for?

If you are injured in an accident for which you are not to blame, or an accident for which you are only partly to blame, you can claim against the RAF for the following:

·       Past and future medical expenses

·       Loss of income

·       General damages for pain and suffering (only if your injury is classified as serious)

What if a breadwinner is deceased?

If you are the child, spouse or parent dependent on the income of a close member of your family who died in an accident that was someone else’s fault, or who was partly someone else’s fault, you are entitled to file a loss of support claim with the RAF.

You can also claim compensation for funeral costs but these are limited to the cost of cremating the deceased or interring the remains.

How much compensation can I get?

The RAF also has specific limitations, for example, currently in 2018, the maximum payout for loss of income due to your injury is R238,670.

What does the RAF not cover?

The RAF does not cover any damage to personal property or vehicles. In addition, you will not be able to claim from the RAF if:

·       you were solely responsible for the accident

·       you were the only person involved in the accident, for example, you drove your car into a tree, and the accident was not due to someone else’s negligence.
